Yet they always come back with the 'preferred rate' for that area at something like $105. Its funny how they word it. "It can be like me walking into Wal-Mart and picking up a $5 item, shoving $3 on the clerk's counter and walking out with it," Chal- lancin adds. "'I'm sorry, but my preferred price on this is $3, and I'll see you later.' I think everybody can understand that. That's what the insurance companies have done or are trying to do to our industry." Battling It Out in Court Legal documents in Tradewinds' two current lawsuits show the repair shop's strategy and the tactics the insurers take in response. In the case of the repair to the 2012 Winnebago Itasca Meridian, the customer came to Tradewinds in April 2013 seeking the repair. She signed an "assignment of benefits" to Tradewinds that allowed the repair shop to pursue the insurer for any amounts still owed on the invoice. The insurer inspected the damage and, according to Tradewinds' lawsuit, "knowingly or reasonably should have known that it under- estimated the amount necessary, reasonable and/or competitive in the market area … to bring the damaged Winnebago back to pre-loss condition." The insurer responded to the lawsuit by saying Tradewinds Painter Aaron Fiehn sands a panel of a coach to prepare it for painting.
