USMX has also been instrumental m the creation and implementation of the TWIC program at East and Gulf Coast ports. USMX is preparing a response to a re- port, scheduled for presentation in 2011 by the Government Accountability OI- rice, which will address deployment is- sues such as TWIC usage and v e r i fi c a t i o n . USMX participates in theTWIC Stakeholder Committee that meets with the TSA to review enrollment issues and the introduction of new procedures USMX, on behalf of its members, submitted comments on r ulemaking procedures and questions to the Coast Guard Policy Advisory Coun- ctl in order to clarity the require- ments ttlat must be met when TWIC biometric readers are installed at ma- rine terminals USMX assisted in the preparation of liti- gation materials in the District of Co- lumbia federal circuit court action addressing OSHA's Vertical Tandem Lift standard USMX participated as a stakeholder in OSHA regulatory issues, including its recent plan to implement Injury and Illness Prevention Programs This is a plan that the industry opposes because it will increase regulation without improv- ing safety USMX participated as a stakeholder in the legislative process and ensuing regu- latory process to ensure that chassis roadability regulations were appropriate tor the industry. USMX continues to monitor the im- plementation of these regulations with regard to remaining utLresolved issues concerning recordkeeping and reporting and impact on contractual i s s u e s L I I I G A I I O N USMX, in concert with NYSA, is seeking to recover the damages caused by the ILA's two-day strike in September 2010 USMX continues to be prepared to seek injunctive relief whenever the ILA threatens any job action prompted by a Master Contract issue USMX continues to represent theinter- ests of the industry by monitoring the federal case in Brooklyn brought against MILA and several other individuals and other Taft-Hartley Funds d~
