Ask The Expert: Taming the Data Explosion you have to start with the process first. Get your policies, processes and procedures right, and then find the technology that allows you to actualize that. Todd: No question; it's the process. If we don't institute strong data governance, workflow and process, the technology doesn't matter. You can't manage human behavior with technology alone, not if you want the technology to actually serve the business. You have to have strong policies, and they have to be enforced if you want data to be secure. The technology can only go so far. The biggest issue to address is education. We have to ensure that users understand the risks, adhere to firm policies on organizing and managing their data, and that they remain vigilant with these practices. That's not complex; it's just a lot of work that requires support from firm management. What's the one thing that is most helpful with data management efforts? Todd: Management listens to us and demonstrates leadership in this area. They're busy attorneys, but they understand the risk. They've responded with support for our technology training budget, and they're getting the message to users that this issue matters and is part of responsible lawyering. I'm very fortunate to be working for management that believes in this. But all firms need to work together on this effort — we're business partners, we're co-counsel and many times we've got the same clients. Eric: You need to have the right people in place who can help identify what's important to the company and come up with the policies, procedures and processes to realize that. The right people also need to explain goals, decisions and processes in the corporation and to outside counsel. Sean: There are various tools out there for data loss prevention and data insight, including Symantec's Suite and Varonis, that allow you to get highly nuanced, highly contextual analyses of the data you have and attendant risks around it, especially from a compliance point of view. Adam: Having defined goals and objectives. Ask yourself these questions: What kind of content are you going to let your users store? What personal data (e.g., music) are you going to let users have on their shared folders? What limits will you put on the size of your attorneys' and paralegals' email inboxes? Defining what your organization wants can help you decide what kind of technology you want in place.
