What are my legal obligations? Pool Fencing - Summary Only Contact your local authority for requirements that pertain to your country, state or area. Regulations can differ from state to state and country to country. By law in Australia and many countries throughout the world, you are required to install a pool safety fence around your pool or spa. Your pool fence must have a self-closing gate with a safety latch/magnetic latch. It must also be compliant with the height the regulations require. There must be no objects that a child can climb up to scale the fence. This includes trees, shrubs, retaining walls, toys, ladders or any other item that can give a child a leg up. You must have a resuscitation chart displayed and it must be readable. Please contact your local authority/council to obtain the regulations. Ask your Pool Professional to check and advise you. It is his duty of care to make you aware of any defects your pool may have. Remember that a pool fence is designed to keep children out unless they are supervised by an adult. 42
